This applicant Privacy Policy describes the privacy practices that apply to Similarweb Ltd.’s, together with its group companies listed below (“Similarweb,” “we” or “us”) collection, processing, use and disclosure of your Personal Information submitted via any method as part of the application process for engagement, recruitment and onboarding. In doing so, we respect your privacy rights, and we provide this policy (“Privacy Policy”) to make you aware of the processes described above. We also explain in this Privacy Policy certain rights that you have in respect of your Personal Information. We will not use or share your information with anyone except as described in this Privacy Policy.

For the purposes of this Privacy Policy, “Personal Information” is information that identifies an individual or may with reasonable effort allow the identification of an individual.

We will investigate and attempt to resolve complaints and disputes and will make every reasonable effort to honour your wish to exercise your rights.

For the purposes of this Privacy Policy, Similarweb’s group companies include Similarweb Ltd. (an Israeli company), Similarweb Inc. (a Delaware company), Similarweb UK Ltd. (an English limited company), Similarweb France SAS (a French company), Similarweb Australia Pty Ltd. (an Australian company), Similarweb Germany GmbH (a German company), Similarweb SG Pte Ltd. (a Singapore company) and Similarweb KK Japan (a Japanese company).

The Similarweb group company who you apply to work for will be the entity that determines the purpose and means of processing of your Personal Information (i.e. the data controller). In addition, where processing of your Personal Information is undertaken by other Similarweb group companies, these companies may also be data controllers of such Personal Information. 

PERSONAL INFORMATION COLLECTED

We collect, use, store and transfer Personal Information that is related to your application, such as:

  • Identification Data (such as your first name, last name, username or similar identifier; “Identification Data”) 
  • Contact Data (such as address, telephone number, e-mail address, etc.; “Contact Data”);
  • Information about your professional training, educational and employment background, work permit or visa information;
  • Where necessary and permitted by local applicable laws, further data that you to provide us in connection with your application and employment (e.g., financial data such as bank account details, photo on your CV, marital status, title, date of birth, gender, passport information including number, name, country of issue and expiry date etc.)
  • Equality and diversity data, where required by law and provided voluntarily;
  • Device data (such as device, location and usage data, an online identifier internet protocol (IP) addresses, cookie identifiers etc. Please see our website privacy policy at https://www.similarweb.com/corp/legal/privacy-policy/)

This Personal Information may come in the form of your application submitted via an external platform, our website, email, through the context of your application in a CV, resume, employee referral, cover letter and educational transcripts or from managers and human resource professionals involved in the recruitment and interviewing process. 

Some of your Personal Information is essential for the application process or for the entering into a contract regarding your engagement by us. Where this is the case, you will be notified of the mandatory nature of such information and the consequences of not providing the information requested. For example in some cases, we will not be able to make a decision regarding your application and your potential engagement by us without the relevant information. 

We may also receive Personal Information about you from third parties such as recruitment agencies, employment references and from publicly available sources. If you contact us, we will keep a record of that correspondence. 

Like most website operators, we also collect web server log information of the sort that web browsers and servers typically make available (“Web Server Information”). This Web Server Information includes non-personally-identifying information such as browser type, language preference, and the date and time of each visitor request, as well as potentially personally-identifying information like Internet Protocol (IP) addresses.

THE PURPOSES FOR WHICH PERSONAL INFORMATION IS PROCESSED AND OUR LEGAL BASIS FOR CARRYING OUT THE PROCESSING

We have set out below the purposes for which we may use your Personal Information. Information may occasionally be used for purposes not obvious to you where the circumstances warrant such use. We may, where we think it is necessary, provide you with additional information in relevant policies to ensure that you understand how your Personal Information may be used.

The Legal Basis for Using Your Personal Information

Whenever we process your Personal Information, we do so on the basis of a legal justification for that processing. Processing of special categories of data / sensitive data is always justified on the basis of an additional lawful condition. In the majority of cases, the processing will be justified on one of the following bases: 

  • We may process your Personal Information as necessary to comply with Similarweb’s legal obligations. 
  • Where there is no legal obligation, we will process your Personal Information where the processing is necessary for the performance of a contract to which you are a party or in order to take steps at your request prior to entering into such a contract.
  • Where the above two grounds do not apply, we may process your personal data where the processing is necessary for Similarweb’s legitimate interests except where such interests are overridden by your interests or fundamental rights and freedoms which require protection of Personal Information. 
  • We may on occasion process your personal data for the purpose of legitimate interests pursued by a third party, except where such interests are overridden by your interests or fundamental rights and freedoms which require protection of personal data (for example to meet the security or safeguarding requirements of our customers).
  • In exceptional circumstances, we may carry out the processing on the basis of your consent. Where we rely on consent we will make this clear at the time.

We have set out below the purposes for which we may use your Personal Information and the legal basis we rely on in each case. If you would like to find out more about the legal basis for which we process Personal Information, please contact our Data Protection Officer at dpo@similarweb.com.

How the Personal Information is Used and the legal basis that applies
We will use your Personal Information obtained in the application and recruitment process for purposes set out below:

Some of this processing is necessary for takings steps at your request to enter into a contract with you, if applicable.

Additional processing is necessary for the purpose of the legitimate interests pursued by Similarweb e.g. in order to register you as a new user on Greenhouse (our recruitment software).

Similarweb has a legitimate interest in fully assessing applicants to ensure that only suitable and appropriate candidates are selected, to make a fair decision on the most appropriate candidate for the position.

Similarweb aims to recruit the best person for each vacancy through fair, systematic, effective recruitment and selection procedures. This will contribute towards Similarweb continuing to meet its business objectives, maintain its reputation and attract high calibre employees.

We have a legitimate interest in maintaining an appropriate pool of talent who have shown an interest in working for Similarweb and who are potentially suitable candidates for employment.  This will potentially benefit both initially unsuccessful candidates and Similarweb.

b) Pre-employment verification and screening & in employment screening
Appropriate pre-employment screening including, where relevant and appropriate, identity check, right to work verification, reference check, relevant employment history and relevant professional and educational qualifications.
Some of this processing is necessary for the compliance with legal obligations to which Similarweb is subject, including  establishment of the right to work in the country in which you are employed.

Screening which is not legally required is necessary for the purpose of the legitimate interests pursued by Similarweb.

Similarweb has a legitimate interest in ensuring that those who work for us, and particularly those holding senior office, do not pose an unacceptable risk to the business or its customers and considers the verification carried out necessary to prevent crime and other unlawful acts and to protect the business and customers from fraud or dishonesty.

c) Offers of employment and on-boarding
Preparing an offer letter and employment contract for you (if applicable)
Some of this processing is necessary for the compliance with legal obligations to which Similarweb is subject, including the requirement to issue written particulars or terms of employment and the requirement not to unlawfully discriminate in the terms of any offer to you.

Additional processing is necessary to take steps to enter into the contract between you and Similarweb and to perform that contract because we will need information to make an appropriate offer to you and administer your employment contract if you join us. Information collected and submitted during the recruitment process will become part of your employment record, if you are offered and accept a position with us.

The remainder of the processing is necessary for the purpose of the legitimate interests pursued by Similarweb.

We have a legitimate interest in ensuring the effective engagement of staff on appropriate terms and conditions of employment and that there is a smooth transition into employment for successful candidates and that information supplied in the recruitment process which is relevant to ongoing employment is maintained. This will contribute towards Similarweb continuing to meet its business objectives, maintain its reputation and attract high calibre employees.

d) Recruitment feedback and complaints
To deal with any query, challenge or request for feedback received in relation to our recruitment decisions.
This processing is necessary for compliance with legal obligations to which Similarweb is subject, including ensuring that Similarweb is able to demonstrate its compliance with data protection laws and anti-discrimination laws.

Beyond legal compliance, processing is necessary for the purpose of the legitimate interests pursued by Similarweb.

Similarweb has a legitimate interest in being able to provide feedback to candidates and to be able to defend any challenge or claim made in connection with our recruitment decision.  This will assist Similarweb to avoid the risk of financial exposure or costs incurred through challenges to recruitment decisions and to maintain its reputation.

This also helps us maintain and improve our recruitment process.

e) Legal compliance
Complying with laws and regulations applicable to Similarweb (for example health and safety legislation, taxation rules, other employment laws, and regulation applicable to the conduct of its business).
This processing is necessary for the compliance with legal obligations to which Similarweb is subject.
f) Ensuring equality of opportunity
Monitoring programmes to ensure equality of opportunity and diversity with regard to personal characteristics protected under applicable anti-discrimination laws.
This processing is only carried out where necessary for the compliance with legal obligations to which Similarweb is subject, including anti-discrimination laws and diversity pay reporting obligations.
g) Complaints, claims and litigation
To enforce our legal rights and obligations, and for any purposes in connection with any complaint or legal claim made by, against or otherwise involving you.
This processing is necessary for the purpose of the legitimate interests pursued by Similarweb. 

Similarweb has a legitimate interest in protecting its organisation from breaches of legal obligations owed to it and defending itself against litigation. This is needed to ensure that Similarweb’s legal rights and interests are protected appropriately, to protect Similarweb’s reputation and to protect us from other damage or loss.

h) Legal or regulatory disclosures
To comply with lawful requests by public authorities (including without limitation to meet national security or law enforcement requirements), discovery requests, or where otherwise required or permitted by applicable laws, court orders, government regulations, or regulatory authorities (including without limitation data protection, tax and employment), whether within or outside your country.
This processing is necessary for the compliance with legal obligations to which Similarweb is subject, where there is a legal obligation to disclose information to a court or other legal order to provide information.

Where not legally required, processing is necessary for the purpose of the legitimate interests pursued by Similarweb.

Similarweb has a legitimate interest in cooperating with relevant authorities, government bodies, or regulators for the provision of information, where appropriate. 

 

Special Category Data

To the extent permitted by applicable laws, Similarweb collects and processes a limited amount of Personal Information within the above data listed in the “Personal Information Collected” section above, falling into special categories, sometimes called “sensitive personal data”. Special category data includes Personal Information revealing racial or ethnic origin, political opinions, religious or philosophical belief, trade union membership, genetic data, biometric data, data concerning health or data concerning sex life or sexual orientation.  The special categories of data that are processed by Similarweb for recruitment and the purposes we use it for are set out below. In most cases, this will only arise where you have provided this information to us.  Where we process special categories of data, it will be justified by a legal basis set out above and also by one of the following additional conditions:

  • The processing is necessary for the purposes of carrying out the obligations and exercising the rights of you or Similarweb in the field of employment law, social security and social protection law, to the extent permissible under applicable laws; 
  • The processing is necessary to protect your vital interests or of another person where you are physically or legally incapable of giving consent (for example in exceptional emergency situations, such as a medical emergency); 
  • The processing is necessary for purposes authorised by applicable law in the jurisdiction in which you apply to work. This includes those set out in the, “Processing Information relating to Criminal Convictions and Offences” section of this Privacy Policy;
  • The processing is necessary for the establishment, exercise or defence of legal claims; or
  • In exceptional circumstances the processing is carried out subject to your explicit consent (as explained below).

The purposes we use special category personal data for and the additional legal basis that applies

We have identified a number of purposes for collecting and processing your special category personal data. These are set out below together with the additional legal basis we rely on in each case:

b) Health information may be used to comply with employment, health and safety or social security laws where you provide this information to us.  For example, to make reasonable accommodations or adjustments and avoid unlawful discrimination or dealing with complaints arising in this regard. This processing is necessary for the purposes of carrying out the obligations and exercising the rights of you or Similarweb in the field of employment law, social security and social protection law, to the extent permissible under applicable laws. In particular, health and safety and anti-discrimination laws.
c) Special category personal data of any type may be used in the event of a complaint, claim or litigation or potential claim or litigation by or involving you. This processing is necessary to establish, exercise or defend legal claims.

 

We may seek your consent to certain processing which is not otherwise justified under one of the above bases.  If consent is required for the processing in question, it will be sought from you separately to ensure that it is freely given, informed and explicit.  Information regarding such processing will be provided to you at the time that consent is requested, along with the impact of not providing any such consent.  You should be aware that it is not a condition or requirement of progressing your application to agree to any request for consent from Similarweb.

Processing Information relating to criminal convictions and offences

Personal Information relating to criminal convictions and offences will only be processed where authorised by applicable laws.  This includes where:

  • the processing is necessary for the prevention or detection of unlawful acts where it must be carried out without consent so as not to prejudice those purposes; and/or
  • the processing is necessary for the purposes of complying with or assisting other persons to comply with a regulatory requirement which involves a person taking steps to establish whether another person has committed an unlawful act, been involved in dishonesty, malpractice or other seriously improper conduct. 

Automated decision making and profiling

We do not currently rely on automated decision making.

HOW THE PERSONAL INFORMATION IS SHARED

We limit access to your Personal Information to persons within Similarweb who need this data to facilitate the recruitment process, fulfil contractual and legal obligations or to implement our legitimate interests (including our HR department and relevant supervisors, employees and the members of the team to which you are applying) and to third parties who have a legitimate purpose for accessing it such as service providers, recruiters, consultants, and attorneys. 

Where we share your Personal Information with third parties acting as “data processors”, such parties will carry out their tasks on our behalf and upon our instructions. We also ensure that any data processors we use are under contractual obligations to adequately secure your Personal Information. 

In particular, we use the services of Greenhouse Software Inc., 18 West 18th Street, 11th Floor New York, NY 10011 USA (“Greenhouse”) to process your data and to facilitate, organize and record the recruitment process. This process is necessary for the establishment of an employment relationship between us and potential applicants. 

The information shared with Greenhouse includes:

  • Identification Data; 
  • Contact Data;
  • Job applicant information (education, employment history, resume, hobbies, and other work experience information);
  • Any further data that you provide to us in connection with your application and employment.

Greenhouse acts as a data processor and we will only disclose your Personal Information to the extent necessary to provide the required service.  

We may share your Personal Information with regulatory bodies, or government agencies in order to comply with applicable laws and regulations or to exercise, establish or defend our legal rights. 

Furthermore, we may share some or all of your Personal Information with our current or future subsidiaries, joint venture partners or other companies with whom we are under common control, provided such parties undertake to protect your privacy in at least the same manner as set out in this Privacy Policy. 

HOW LONG WE RETAIN YOUR PERSONAL INFORMATION

We store your Personal Information for as long as it is necessary for the decision about your application or, if applicable, in order to prepare an employment contract in the event that we decide to recruit you.  If an employment relationship is established following the application process, we may further process the Personal Information for the purposes of the employment relationship. 

If you are not extended an offer of employment or have not accepted an offer, we may retain your Personal Information and/or application documents for a maximum period of 12 months after the recruitment process is complete or in line with the applicable data retention regulations in the country where the job has been posted. With your permission, we may retain your Personal Information for longer, in order to contact you in the future about possible suitable positions at Similarweb. 

In some circumstances we may store your Personal Information for longer periods of time, for instance where we are required to do so in accordance with legal, regulatory, tax or accounting requirements or, if deleting or anonymizing it is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it until deletion is possible.

HOW WE PROTECT AND STORE YOUR PERSONAL INFORMATION

We have implemented and maintain appropriate technical and organizational security measures, policies and procedures designed to reduce the risk of accidental destruction or loss, or the unauthorized disclosure or access to such information appropriate to the nature of the information concerned. Note that, although we take measures to secure the information we collect and reduce the risk of unwanted disclosure, we cannot guarantee that the information will not be exposed as a result of unauthorized penetration to our servers. However, we make commercially reasonable efforts to make the collection and security of such information consistent with this Privacy Policy and all applicable laws and regulations. As the security of information depends in part on the security of the computer you use to communicate with us and the security you use to protect your user IDs and passwords, please take appropriate measures to protect this information. 

TRANSFERS OF PERSONAL INFORMATION

Please be aware that your Personal Information may be transferred, stored and processed in countries outside your country of residence from which the information was collected, including the United States. This means that your Personal Information may be subject to a different standard of data protection than that available in your country of residence. Similarweb will take appropriate steps to ensure that transfers of Personal Information are in accordance with applicable laws and carefully managed to protect your privacy rights and interests. To this end:

  • we ensure transfers within Similarweb will be covered by an agreement entered into by members of Similarweb (an intra-group agreement) which contractually obliges each member to ensure that Personal Information receives an adequate and consistent level of protection wherever it is transferred within Similarweb;
  • where applicable, Similarweb has signed standard contractual clauses (as approved by the European Commission or other supervisory authority with jurisdiction over the relevant Similarweb exporter) with third parties (including Similarweb group companies) to whom we transfer your Personal Information in order to provide us with certain services. You can obtain a copy of any standard contractual clauses in place which relate to transfers of your Personal Information by contacting us at dpo@similarweb.com; or
  • where we receive requests for information from law enforcement or regulators, we carefully validate these requests before any Personal Information is disclosed.

Subject to applicable laws, you have a right to contact us for more information about the safeguards we have put in place to ensure the adequate protection of your Personal Information when it is transferred as mentioned above. Any data transfer agreement made available to you may be redacted for reasons of commercial sensitivity. See the “Your Rights” section below for more details. 

YOUR RIGHTS

Depending on your jurisdiction you may have the right to ask Similarweb to amend any Personal Information it holds about you if it is inaccurate or misleading by emailing our Data Protection Officer at dpo@similarweb.com, though we may need to verify the accuracy of the new data you provide to us.

The following rights, which may be subject to certain exemptions, apply (in addition to the rights set forth above) solely to European Economic Area (EEA) and UK users:

  • You have a right to access information held about you and to request correction of any inaccurate data relating to you. Your right of access can normally be exercised free of charge, however we reserve the right to charge an appropriate administrative fee where permitted by applicable law. You also have a responsibility to ensure that changes in your personal circumstances (e.g. change of address) are notified to Similarweb so that we can ensure that your Personal Information is updated.
  • You have a right to request deletion of any irrelevant data we hold about you, insofar as this does not conflict with any of our retention obligations. 
  • You have a right to restrict the processing of your Personal Information, where (i) you contest the accuracy of the Personal Information until we have taken sufficient steps to correct or verify its accuracy; (ii) the processing is unlawful, but you do not want us to erase the data; (iii) we no longer need the Personal Information for the purposes of the processing, but you require them for the establishment, exercise or defence of legal claims; or (iv) you have objected to the processing justified on legitimate interest grounds pending verification as to whether Similarweb has compelling legitimate grounds to continue processing. 

Where Personal Information is subjected to restriction in this way, we will only process it with your consent or for the establishment, exercise or defence of legal claims. 

  • Where we are relying upon your consent or the fact that the processing is necessary for the performance of a contract to which you are party and that Personal Information is processed by automated means, you have a right to data portability and may request the transfer of your Personal Information to you or to a third party. Where technically feasible, we will provide you or the third party with a portable copy, in a structured, commonly used and machine-readable format, of your Personal Information held by us.
  • Where we are relying upon legitimate interest to process Personal Information, you have a right to object to that data processing, provided however that in some cases, we may demonstrate that we have compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.
  • You also have a right to request details of the basis on which your Personal Information is transferred outside the UK or EEA but you acknowledge that data transfer agreements may need to be partially redacted for reasons of commercial confidentiality.
  • If you have consented to the processing of your data, you are entitled to revoke your consent to the processing of your Personal Information at any time. Such revocation is only effective for future processing and has no effect on processing that took place before your notice of revocation was received. You can revoke your consent by contacting us at dpo@similarweb.com. 
  • You have a right to lodge a complaint with your local supervisory authority if you have concerns about how we are processing your Personal Information. We ask that you please attempt to resolve any issues with us first, although you have a right to contact your supervisory authority at any time.

We may ask you for additional information to confirm your identity and for security purposes, before disclosing the Personal Information requested. We reserve the right to charge a fee where permitted by law, for instance if your request is manifestly unfounded or excessive.

You can exercise your rights by contacting our Data Protection Officer at dpo@similarweb.com. Subject to legal and other permissible considerations, we will make every reasonable effort to honor your request promptly or inform you if we require further information in order to fulfil your request.

We may not always be able to fully address your request, for example if it would impact the duty of confidentiality we owe to others, or if we are legally entitled to deal with the request in a different way.

If you have consented to the processing of your data, you may to revoke your consent to the processing of your Personal Information at any time. Such revocation is only effective for future processing and has no effect on Processing that took place before your notice of revocation was received.

If you are not a resident of the UK or the EEA and depending on your jurisdiction, you may have additional or alternative rights to those which are listed herein.

YOUR RESPONSIBILITIES

You are responsible for the information made available to us, including ensuring that it is truthful, up to date and accurate. Furthermore, you must ensure that any other person, such as persons provided as references, have received notice and consent to be contacted by us and to have their information collected and used by us in the context of your recruitment process. 

CHANGES TO THIS PRIVACY POLICY

This Privacy Policy may be updated from time to time and therefore we ask you to check back periodically for the latest version of the Privacy Policy, as indicated in the “Last updated:” date at the bottom of the policy. If there will be any significant changes made to the use of your Personal Information in a manner different from that stated at the time of collection, we will endeavour to notify you by posting a notice on our website.
